Estate Planning

An Estate Plan is a group of legal documents designed to accomplish two objectives — first, to designate those who will make financial and health care decisions for you in the event you lose capacity, and second, to determine how and to whom your assets will pass after your death.

We work with individuals, couples and families at all stages of life and at all wealth levels to prepare a customized Estate Plan. The Estate Plans include Durable Powers of Attorney, Health Care Proxies, Living Wills, HIPAA authorizations, Wills, and Revocable Trusts. We incorporate estate tax planning into Revocable Trusts and provide advice about other strategies to minimize or eliminate Massachusetts and federal estate taxes.

For many clients, we offer more complex planning techniques, including Irrevocable Life Insurance Trusts (ILITs) to own life insurance policies, Irrevocable Gift Trusts, Dynasty Trusts, Grantor Retained Annuity Trusts (GRATs), and Spousal Lifetime Access Trusts (SLATs).

As part of the Estate Planning process we guide clients about the titling of assets, including real estate, and the designation of beneficiaries of life insurance policies and retirement accounts. Our goals are to work with clients to avoid probate, to minimize taxes, and to simplify estate administration after death.

We also help clients plan for end-of-life health care needs, including preparation of and advice about living wills, advanced care directives, dementia directives, and MOLSTs. We can also assist with the purchase of long term care insurance and life insurance with long term care options.
